Data Processing Information on Linkedin
GDPR information regarding the QAbird profile under the name “QAbird” on Linkedin
Pursuant to Art. 13 sec. 1 and 2 and Art. 14 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 94/46/EC (General Data Protection Regulation ), (hereinafter referred to as “GDPR”), we inform you how we will process your personal data provided when using your profile on a social networking site (hereinafter referred to as “fanpage”), we inform you that:
1. The administrator of your personal data is QA Bird sp. z o.o. with its registered office in Warsaw, at ul. Nowogrodzka 56A, 00-695 Warsaw, NIP: 1231514308, REGON: 522287428, KRS: 0000973708.
2. Regarding the protection of your personal data, you can contact the Data Protection Officer appointed by the administrator at the email address: gdpr@qabird.com or in writing to the address of the Administrator’s registered office.
3. Categories of persons whose data is processed:
The administrator processes the data of persons who:
a) They provide theirs on Linkedin in connection with the use of the Administrator’s profile. These data may be available to the administrator of this portal – i.e. Linkedin,
b) all personal data contained in comments posted on the Administrator’s profile may also be available to other users of the Linkedin portal.
4. Personal data will be processed for the following purposes:
a) in order to maintain the Administrator’s profile on the Linkedin social network, on the terms and conditions set out by Linkedin and in order to use it to inform about the Administrator’s activity, promote various events,
b) in order to communicate via the available functionalities of the Linkedin website – comments, chat, messages or by posting your comment under any of the posts posted on the Administrator’s profile,
c) for analytical purposes regarding the analysis of functioning, popularity, how to use the profile,
d) in order to possibly determine, investigate or defend against claims,
e) Your personal data may also be processed on the basis of a separate consent to the extent and purpose specified in the content of the consent and for the period until the consent is withdrawn (the basis of Article 6(1)(a) of the GDPR),
f) Your personal data may also be processed on the basis of statutory requirements (the basis of Article 6(1)(c) of the GDPR) in order to fulfill the Administrator’s legal obligations under the law.
In addition, we would like to inform you that the administrator of the Linkedin portal as a supplier of tools is an entity jointly responsible for the processing of data of persons using the Administrator’s company profile, which may process their data for its own purposes based on other legal grounds. In particular, Linkedin, based on its own provisions and regulations, may collect and process information contained in cookie files of people visiting the profile. Based on the data collected in this way, Linkedin may create anonymous statements and statistics (e.g. regarding the number or profile of visitors), which may be made available to the Administrator as the person running the profile.
5. Data storage period:
a) data processed on the basis of consent will be processed until the consent is withdrawn,
b) data processed on the basis of statutory requirements will be processed for the time in which the law requires data storage,
c) data processed on the basis of the Administrator’s legitimate interest will be processed until the objection is effectively filed or this interest ceases, e.g. data processed for the purpose of pursuing or defending against claims will be processed for a period equal to the period of limitation of these claims,
d) in connection with the specification of the Linkedin portal, information about people following the profile, as well as the content of comments, posts and other information provided by users are public,
e) Your data, which will be processed as part of your comments on the profile, will be available on the website until they are removed by the author or the profile Administrator.
6. Your rights:
In connection with the processing of personal data, you have the following rights:
a) the right to access your data and receive a copy thereof,
b) the right to rectify (correct) your data,
c) the right to delete data,
d) the right to limit data processing,
e) the right to object to data processing,
f) the right to transfer data,
g) the right to withdraw consent to the processing of personal data – you have the right to withdraw consent to the processing of personal data processed on the basis of consent at any time. Withdrawal of consent will not affect the lawfulness of the processing that was made on the basis of consent before its withdrawal.
h) You have the right to lodge a complaint to the President of the Office for Personal Data Protection, ul. Stawki 2, when you consider that the processing of your personal data violates the provisions of the GDPR.
7. Information about the data source:
We obtain your data from the Linkedin provider, from your public profile and entries on the Administrator’s profile.
8. Other information:
a) Personal data will be processed in an automated manner, including in the form of profiling. Automated decision-making will take place on the terms set out in the Linkedin regulations, the consequence of such processing will be contact, displaying information from the Profile Administrator.
b) The processing of data obtained from you by the Administrator will be based on the principle of voluntary provision, in a situation where the processing of personal data is based on consent. Processing may also be a statutory requirement, e.g. in the event of the need to archive documentation containing data in accordance with applicable law.
Stosownie do art. 13 ust. 1 i 2 i art. 14 Rozporządzenia Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27 kwietnia 2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 94/46/WE (ogólne rozporządzenie o ochronie danych), (dalej zwane „RODO”) informujemy w jaki sposób przetwarzać będziemy Państwa dane osobowe udostępnione w trakcie korzystania z profilu w serwisie społecznościowego (dalej „fanpage”) informujemy Państwa, że:
1. Administratorem Państwa danych osobowych jest QA Bird sp. z o.o. z siedzibą w Warszawie, przy ul. Nowogrodzkiej 56A, 00-695 Warszawa, NIP: 1231514308, REGON: 522287428, KRS: 0000973708.
2. W sprawie ochrony swoich danych osobowych może Pani/Pan kontaktować się z wyznaczonym przez administratora Inspektorem Ochrony Danych pod adresem email: gdpr@qabird.com lub pisemnie na adres siedziby Administratora.
3. Kategorie osób, których dane są przetwarzane:
Administrator przetwarza dane osób, które:
a) Podają swoje na portalu Linkedin w związku z korzystaniem z profilu Administratora. Dane te mogą być dostępne dla administratora tego portalu – tj. Linkedin,
b) wszelkie dane osobowe zawarte w komentarzach zamieszczanych na profilu Administratora mogą być również dostępne dla innych użytkowników portalu Linkedin.
4. Dane osobowe będą przetwarzane w następujących celach:
a) w celu prowadzenia profilu Administratora na portalu społecznościowym Linkedin, na warunkach oraz na zasadach określonych przez Linkedin oraz w celu informowania za jego pomocą o aktywności Administratora, promowania różnych wydarzeń,
b) w celu komunikacji za pośrednictwem dostępnych funkcjonalności serwisu Linkedin – komentarze, chat, wiadomości lub poprzez opublikowanie swojego komentarza pod którymkolwiek z postów zamieszczonych na profilu Administratora,
c) w celach analitycznych dotyczących analiz funkcjonowania, popularności, sposobu korzystania z profilu,
d) w celu ewentualnego ustalenia, dochodzenia lub obrony przed roszczeniami,
e) Państwa dane osobowe przetwarzane mogą być również na podstawie odrębnie udzielonej zgody w zakresie i celu określonym w treści zgody i przez okres do czasu cofnięcia zgody (podstawa z art. 6 ust. 1 lit a. RODO),
f) Państwa dane osobowe przetwarzane mogą być również na podstawie wymogów ustawowych (podstawa z art. 6 ust. 1 lit. c RODO) w celu wypełnienia przez Administratora obowiązków prawnych wynikających z przepisów prawa.
Ponadto informujemy, że administrator portalu Linkedin jako dostawca narzędzi jest podmiotem współodpowiedzialnym za przetwarzanie danych osób korzystających z profilu firmowego Administratora, który może przetwarzać ich dane we własnych celach oparciu o inne podstawy prawne. W szczególności Linkedin w oparciu o własne postanowienia i regulaminy może gromadzić i przetwarzać informacje zawarte w plikach cookies osób odwiedzających profil. W oparciu o tak zebrane dane mogą być przez Linkedin tworzone anonimowe zestawienia i statystyki (np. dotyczące liczby czy profilu odwiedzających), które mogą być udostępniane Administratorowi jako prowadzącemu profil.
5. Okres przechowywania danych:
a) dane przetwarzane na podstawie zgody będą przetwarzane do czasu cofnięcia zgody,
b) dane przetwarzane na podstawie wymogów ustawowych będą przetwarzane przez czas, w którym przepisy prawa nakazują przechowanie danych,
c) dane przetwarzane na podstawie prawnie uzasadnionego interesu Administratora będą przetwarzane do czasu skutecznego złożenia sprzeciwu lub ustania tego interesu, np. dane przetwarzane w celu dochodzenia lub obrony przed roszczeniami będą przetwarzane przez czas równy okresowi przedawnienia tych roszczeń,
d) w związku ze specyfikacją portalu Linkedin informacje o osobach obserwujących profil, a także o treści komentarzy, postach i innych informacjach dostarczanych przez użytkowników są jawne,
e) Państwa dane, które przetwarzane będą w ramach zamieszczanych przez Państwa komentarzy na profilu, będą dostępne w serwisie do czasu usunięcia ich przez autora lub Administratora profilu.
6. Państwa prawa:
W związku z przetwarzaniem danych osobowych przysługują Państwu:
a) prawo dostępu do swoich danych oraz otrzymania ich kopii,
b) prawo do sprostowania (poprawiania) swoich danych,
c) prawo do usunięcia danych,
d) prawo do ograniczenia przetwarzania danych,
e) prawo do wniesienia sprzeciwu wobec przetwarzania danych,
f) prawo do przenoszenia danych,
g) prawo do cofnięcia zgody na przetwarzanie danych osobowych – w każdej chwili mają Państwo prawo cofnąć zgodę na przetwarzanie tych danych osobowych przetwarzanych na podstawie zgody. Cofnięcie zgody nie będzie wpływać na zgodność z prawem przetwarzania, którego dokonano na podstawie zgody przed jej wycofaniem.
h) Przysługuje Państwu prawo wniesienia skargi do Prezesa Urzędu Ochrony Danych Osobowych, ul. Stawki 2, gdy uznają Państwo, że przetwarzanie Państwa danych osobowych narusza przepisy RODO.
7. Informacje o źródle danych:
Państwa dane uzyskujemy od dostawcy Linkedin, z Państwa publicznego profilu oraz wpisów na profilu Administratora.
8. Pozostałe informacje:
a) Dane osobowe będą przetwarzane w sposób zautomatyzowany, w tym również w formie profilowania. Zautomatyzowane podejmowanie decyzji będzie odbywało się na zasadach określonych w regulaminie Linkedin, konsekwencją takiego przetwarzania będzie kontakt, wyświetlanie informacji od Administratora profilu.
b) Przetwarzanie pozyskanych od Państwa danych przez Administratora opierać się będzie na zasadzie dobrowolności ich podania, w sytuacji, gdy przetwarzanie danych osobowych odbywa się na podstawie zgody. Przetwarzanie może być też wymogiem ustawowym, np. w wypadku konieczności archiwizacji dokumentującej zawierającej dane zgodnie z obowiązującymi przepisami prawa.
